Wowpinoy.net acts as the venue for sellers, merchants or service providers to list items or their restaurants, and tourists and/or buyers to search and inquire on such items or services. Other than acting as the venue for such sellers, merchants and service providers and tourists and/or buyers to meet, wowpinoy.net has no participation whatsoever in the actual transaction between sellers/service providers and buyers/tourists. The Department of Tourism, therefore, has no control over the quality, safety or legality of the items or services advertised, the truth or accuracy of the listings, the quality of the service to be provided, the ability of sellers to sell items or the ability of buyers to buy items. The Department of Tourism cannot guarantee that a buyer or seller will actually complete a transaction. Due to the foregoing, in the event that a user has a dispute with one or more users, the Department of Tourism (and our officers, directors, agents, subsidiaries and employees) are deemed released from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such transaction. Only items that are permissible objects of commercial transactions and have not been otherwise declared illegal or outside the commerce of man by competent authorities can be posted on wowpinoy.net. Wowpinoy.net reserves the right to disallow or prevent the posting of items which in wowpinoy.net's sole and exclusive judgment are inappropriate for wowpinoy.net's community.

CHANGE, INTERRUPTION OR TERMINATION OF SERVICE
Wowpinoy.net reserves the right to modify, vary, alter or otherwise change any or all of its services and terms and conditions upon which they are provided without prior notice to wowpinoy.net users. The website, its services and any and all of its aspects, parts or components, or any combination or permutation of such aspects, parts and components, and other intellectual property rights pertaining to it are licensed to the Department of Tourism, and are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

DISCLAIMER OF WARRANTIES
The Department of Tourism makes no and hereby specifically disclaims all warranties, express or implied, including, without limitation, those of merchantability, non infringement and fitness for a particular purpose, with respect to the website and services therein. User assumes the entire risk as to the results and performance of the website and the services therein to the exclusion of The Department of Tourism.

LIMITATION OF LIABILITIES
The Department of Tourism will not be liable to any user or any third party for any and all damages, however classified or categorized, arising out of or related to the use or non-use, misuse, availability or reliance on the website and the services therein notwithstanding the fact that the Department of Tourism shall have been informed or notified of the possibility of the instance of such damages.

The sms (short messaging service) application of wowpinoy.net in its entirety must not be treated as a foolproof tool (101%) for buying, selling, and other service provisions in general as possibilities of technical and network related glitches beyond wowpinoy.net control may arise. Wowpinoy.net does not guarantee that its sms (short messaging service) level of availability will be maintained at a 100% uptime as maintenance related activities may be undertaken at anytime deem fit for which case wowpinoy.net will not be held liable.
